Why ADUs?
In August 2024, Massachusetts enacted the Affordable Homes Act, a transformative piece of legislation aimed at addressing the state’s housing crisis. A key provision of this act is the statewide legalization of Accessory Dwelling Units (ADUs) by right in single-family zoning districts, effective February 2, 2025. This change empowers homeowners to add secondary living spaces—such as in-law suites, backyard cottages, or garage apartments—without the need for special permits or zoning variances.
What This Means for Homeowners
Simplified Approval Process: Previously, building an ADU often required navigating complex local zoning laws and obtaining special permits, which could be time-consuming and uncertain. Under the new law, homeowners can construct ADUs up to 900 square feet or 50% of the primary dwelling’s size (whichever is smaller) by right, streamlining the approval process.
Increased Flexibility: The law removes owner-occupancy requirements, allowing homeowners to rent out either the primary residence or the ADU, or both. This flexibility opens up opportunities for generating rental income or providing housing for family members.
Reduced Parking Mandates: Municipalities cannot require more than one additional parking space for an ADU, and in areas within half a mile of public transit, no additional parking is required.
